The updated version will apply from the date it is published on our website. Your continued use of our website after changes are published means you accept the updated terms.

2. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. If a product or service fails to meet a consumer guarantee, you may be entitled to a repair, replacement, refund, cancellation, compensation, or another remedy depending on the circumstances.

Any warranty, return policy, live arrival guarantee, or product support offered by us applies in addition to your rights under Australian Consumer Law.

3. Eligibility and Account Security

You must be at least 18 years old, or have permission from a parent or legal guardian, to purchase from us.

You are responsible for maintaining the confidentiality of your account details, password, and any activity under your account.

You agree to provide accurate, current, and complete information when placing an order or creating an account.

We may refuse service, suspend accounts, or cancel orders where we reasonably suspect fraud, abuse, unlawful activity, payment issues, or misuse of our website or policies.

4. Products and Services

We take reasonable care to ensure that product descriptions, images, specifications, pricing, and availability are accurate.

However, some variation may occur, including variation in colour, finish, packaging, product revisions, handmade items, live plants, live animals, and natural products.

Product images are provided for general guidance. Actual products may vary slightly from photos due to lighting, screen display, manufacturing differences, biological variation, or natural growth.

We may update, modify, discontinue, or replace products at any time without notice.

Product availability is not guaranteed. If an item becomes unavailable after purchase, we may contact you to arrange a replacement, refund, partial shipment, store credit, or another suitable outcome.

5. Vemtech BioSystems Products

Vemtech BioSystems products may include aquarium foods, live shrimp, live aquarium plants, aquatics accessories, and related products.

Aquarium food and shrimp food products, including Project 11 products, are intended for ornamental aquarium use only. They are not intended for human consumption, livestock feed, aquaculture production, or animals intended for human consumption.

Live shrimp and live plants are perishable live goods. These products are subject to specific shipping conditions, state restrictions, and Live Arrival Guarantee requirements set out in our Shipping Policy and Return and Refund Policy.

Live shrimp and plants cannot be shipped to WA, TAS, or NT.

Customers are responsible for checking that live goods are suitable for their aquarium, local conditions, and intended use before purchase.

6. Product Use and Customer Responsibility

You are responsible for using products safely, correctly, and for their intended purpose.

For electronic products, trackers, accessories, batteries, chargers, cables, and related products, you must follow all provided instructions and safety warnings.

For aquarium foods, plants, shrimp, and aquatics products, you are responsible for maintaining suitable aquarium conditions, water parameters, tank cycling, acclimation, livestock compatibility, and safe handling.

We are not responsible for issues caused by misuse, incorrect installation, unsuitable environments, unauthorised modification, unsafe handling, incompatible equipment, poor aquarium conditions, or failure to follow instructions.

7. Pricing and Payment

All prices are listed in Australian dollars unless otherwise stated.

Prices may change at any time without notice.

Payment must be completed before an order is processed or shipped.

You are responsible for any applicable taxes, duties, customs fees, import charges, currency conversion fees, bank fees, or payment provider charges.

We may cancel or refuse orders where payment fails, payment is reversed, fraud is suspected, pricing errors occur, or stock is unavailable.

8. Shipping and Delivery

Shipping times, costs, service availability, restrictions, and handling processes are set out in our Shipping Policy.

Delivery estimates are estimates only and are not guarantees unless expressly stated.

We are not responsible for delays caused by postal carriers, customs, biosecurity checks, incorrect addresses, missed deliveries, parcel redirection, severe weather, public holidays, courier disruptions, or events outside our reasonable control.

For international orders, the customer is responsible for customs duties, taxes, import restrictions, and local compliance.

For live shrimp and live plants, customers are responsible for providing a correct delivery address and ensuring the parcel can be received promptly.

9. Dangerous Goods and Battery Shipping

Some Vemtech Applications products may include lithium batteries or battery-powered components.

Where applicable, we ship battery-containing products in accordance with relevant dangerous goods requirements, including UN3481 handling requirements.

Customers must not misuse, puncture, crush, modify, overheat, short-circuit, immerse, or improperly dispose of batteries or battery-powered products.

10. Returns, Refunds, and Live Arrival Claims

Returns, refunds, change-of-mind returns, damaged items, faulty items, incorrect items, and Live Arrival Guarantee claims are handled under our Return and Refund Policy.

Change-of-mind returns are only accepted for eligible products within the stated return window and subject to the conditions in our Return and Refund Policy.

Live shrimp and live plants are not eligible for change-of-mind returns.

Nothing in our Return and Refund Policy limits your rights under Australian Consumer Law.

11. Warranty

Some products may be covered by a separate warranty.

Warranty terms are set out in our Warranty Policy or on the relevant product page.

Warranty support is provided in addition to your rights under Australian Consumer Law.

Warranty coverage does not apply to issues caused by normal wear and tear, misuse, accidental damage, unauthorised modification, incorrect installation, unsuitable operating conditions, improper storage, water damage unless the product is specifically rated for it, or failure to follow instructions.

12. Custom, Modified, and Made-to-Order Products

Custom, personalised, modified, or made-to-order products may not be eligible for change-of-mind returns.

If a custom, modified, or made-to-order product is faulty, damaged, incorrect, or not as described, please contact us so we can assess the issue and provide an appropriate remedy.

13. Intellectual Property

All product designs, images, logos, branding, written content, product descriptions, graphics, videos, packaging designs, website content, and other materials on this website are owned by or licensed to Vemtech Applications Pty Ltd unless otherwise stated.

You must not copy, reproduce, modify, distribute, sell, reverse engineer, scrape, or use our intellectual property without prior written permission.

Open-source, third-party, or community-derived projects may be subject to their own licences. Nothing in these Terms claims ownership over third-party intellectual property or open-source materials that are not owned by us.

14. Reviews, Photos, and Customer Content

If you submit reviews, photos, videos, comments, feedback, or other content to us or our website, you grant us permission to use that content for store, marketing, support, product improvement, and promotional purposes.

You must not submit content that is false, unlawful, abusive, defamatory, misleading, infringing, obscene, or harmful.

We may remove or refuse to publish customer content at our discretion.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled portion unless we are legally entitled to withhold it.

Where liability cannot be excluded under law, our liability is limited, where permitted, to one or more of the following:

Supply of equivalent goods

This may include postal delays, courier disruptions, customs or biosecurity delays, extreme weather, natural disasters, power outages, supplier shortages, pandemics, government restrictions, system outages, industrial action, or other events beyond our control.

Both parties agree to attempt to resolve disputes through good-faith negotiation before commencing legal proceedings, except where urgent legal action is required.

You agree that any legal proceedings will be brought in the courts of Queensland, Australia, subject to any rights you may have under applicable consumer protection laws.
